Man convicted of sodomy, outraging modesty of 2 boys to be sentenced Saturday

A LOCAL man convicted of sodomising two young boys and forcing one of them to perform oral sex on him will be sentenced this Saturday at the High Court.

Zainal Abidin Jahad is facing nine charges consisting of four counts of sodomy and five counts of outraging modesty in 2012. The boys, whose names are withheld to protect their identities, were aged 12 and 13 years old respectively at the time of the offence.

Following the trial, judicial commissioner Pg Hj Rostaina Pg Hj Duraman acquitted the former employee at the Water Treatment Plant on five of the charges while finding him guilty for three charges of sodomy and one count of outraging the modesty of one of the boys.

Defence counsel Hj Rozaiman Hj Abd Rahman yesterday delivered the mitigation on behalf of the 57 year-old stating his client’s remorse and regrettable action.

“He is also apologetic for his actions to all parties concerned and felt that the sufferings he and his family had gone through since his arrest until today is severe punishment in itself, not to mention the humiliation when charged in court,” said the defence counsel.

Hj Rozaiman further sought for the court to impose a “just and fair lenient” sentence on the defendant in view that Zainal has no previous conviction, that he has lost everything he worked for during his 20 years of service with the government including the retirement funds and pension, as well as coping with some health issues.

In his submission, prosecuting officer Shamshuddin Hj Kamaluddin urged the court to consider taking a closer look on the psychological damage done on the two boys due to the incident. He further urged the court to consider the boys’ relationship with the defendant who had treated the latter as a friend of their father.

The prosecution said that the young boys had to go through trial and were cross examined in court by the defence counsel.

“An experience which they will never forget,” said the prosecution.

Zainal is facing up to 10 years in prison and liable to an unspecified amount in fines for each of the sodomy charges.

For the outraging modesty charge, Zainal is facing an imprisonment term of up to five years. Both prosecution and defence counsel submitted that whippings should be exempted due to the defendant’s age and to be substituted with enhanced sentence.

Zainal was ordered to be further remanded yesterday pending the sentencing on this Saturday, October 15.
