A MAN yesterday pleaded guilty to two charges of assaulting a three-year-old and causing the child’s death last month.

According to court documents prepared by Prosecuting Officer Siti Nurjauinah Hj Kula, the defendant, who was the child’s uncle, assaulted her in a manner likely to cause her physical injury on August 17 around 8.30am at a house in Kg Perpindahan Mentiri Awam.

The defendant admitted to causing the death of the child, who was in his care, with the knowledge that his act was likely to cause death but without the intention to cause death.

The defendant had therefore committed an offence of culpable homicide not amounting to murder, which is punishable under Section 304(2), Chapter 22 of the Penal Code.

He faces up to 15 years in prison.

However, at the High Court yesterday, the defendant pleaded not guilty to and claimed trial over two additional charges of causing injury to a six-year-old child in his care in July this year.

Based on the court documents, the defendant is being charged for assaulting the six-year-old in a manner likely to cause her physical injury as well as voluntarily causing hurt by stubbing a cigarette on her right foot and causing injuries.

Presiding High Court Judge Chief Registrar Pg Datin Paduka Hjh Rostaina Pg Hj Duraman set the trial dates for November 21 onwards.
