Indonesian teacher to face trial in December

AN INDONESIAN teaching at a primary school will face trial this December over charges of outraging the modesty of a student.
The defendant, who cannot be named to protect the identity of the victim, was accused of assaulting an 11- year-old girl by holding her body tightly before kissing her on the lips and touching her chest on June 2.
The trial dates were fixed by the presiding judge at the Intermediate Court yesterday to run from December 12 to 21.
The prosecution indicated to the court that they will be bringing seven to eight witnesses while the defence said they will present a lone witness.
The offence under section 354B of the Penal Code, Chapter 22 carries a minimum penalty of three years imprisonment and a maximum penalty of ten years with whipping.
The prosecution failed to have the defendant’s bail revoked yesterday after he was found to be with his wife at a house in Kg Salambigar, where she runs a stall selling food.
The defendant’s defence counsel, Hj Mohd Rozaiman DSLJ Hj Abd Rahman, argued that his client had not breached bail conditions as he was at the house in Kg Salambigar to accompany his wife.
Furthermore, the defence counsel said that the house in Salambigar is not located near the school where the alleged incident took place.
Presiding Judge Pg Hjh Masni Pg Hj Bahar rejected the prosecution’s application in favour of the defendant to continue being released on bail.
“However, I must stress that should there be any slight contact between the defendant, witnesses or the complainant directly or through relatives, that would be deemed to be a condition for the bail to be revoked, taking into account the nature of the offence,” said the judge.
