Man in outrage of modesty case to be sentenced Saturday

A LOCAL man accused of using criminal force in outraging the modesty of an underage girl will be sentenced on Saturday after maintaining his guilty plea at the Intermediate Court yesterday.

Johari Hj Zaini, 42, allegedly kissed the lips and groped the breasts of the 15-year-old victim, Miss Y, whilst pinning her on the bed with his body in a bedroom at his house in Kg Panchor Mengkubau on April 16, 2016.

He had tricked the victim, who was to be driven to school by the defendant that morning, to go to his house early in the day.

The father of seven was also charged with attempting to rape the victim and trespassing, to both of which he pleaded not guilty earlier.

During yesterday’s proceedings before Presiding Judge Ramzidah PDKD Col (Rtd) Hj Abd Rahman, deputy public prosecutor Shamshuddin Kamaluddin indicated that he will drop the charge of trespassing at the next mention of the case and submitted several aggravating factors to the court in considering the sentence.

The prosecutor said the case was a serious and disturbing one, as he is also a father and that the victim must have been traumatised by the incident.

The prosecutor also pointed out that the victim was a neighbour and that the defendant had abused his position of trust in order to commit the crime.

The suspect is facing a maximum of seven years in prison with whipping for the offence of outraging of modesty and using criminal force in order to do so.
