Rape attempt accused claims trial over house trespass

A 42-YEAR-OLD man pleaded guilty to an alternative charge of aggravated outraging modesty of a minor yesterday but claims trial over the charge of trespassing into a house in Kg Panchor (Mengkubau).

Intermediate Court judge Ramzidah PDKD Hj Abd Rahman adjourned the case yesterday to next week to allow time for prosecuting officer Shamshuddin Hj Kamaluddin to consider whether to proceed with the house trespass charge or not.

The court ordered the defendant to be further remanded in Jerudong Prison after granting the prosecution’s application for the defendant’s bail to be revoked on grounds that the 42-year-old is facing the mandatory imprisonment of two years.

The defendant has been in remand since last month after he failed to raise the $7,000 court bail or find two local sureties for his release. On May 15, the defendant, whose name is withheld to protect the identity of the victim, had his case remitted to the Intermediate Court after prosecution finalised the charges against him.

The defendant, a local man, is accused of attempting to rape a 15-year-old girl inside the bedroom of his house in Kg Mentiri on April 16 this year. The penalty for an attempted rape carries an imprisonment term of not more than half of the 30 years and whippings.

The court document also listed an alternative charge to the rape attempt whereby accusing the defendant of using criminal force on the minor on April 16 this year, by kissing her lips and groping her breasts and voluntarily caused wrongful restraint by pinning the victim on the bed with his body.

During the proceedings yesterday, the defendant denied the rape attempt charge but admitted to the alternative charge of aggravated outraging modesty which carries an imprisonment term of not less than two years and up to seven years in jail with unspecified number of whippings. A further mention of the case will be heard on June 1.
