Three acquitted of cheating charge

THE Magistrates’ Court yesterday discharged and acquitted a man and two women over a charge of duping a woman regarding loan payments on a car they purchased from her.

The defendants - Rahimah Brahim, 47, Mohammad Hanizam Hj Awang, 37 and Siti Sara Hj Daud, 45 - claimed trial over the charge of tricking a woman into selling her Toyota Vios to them on September 13, 2013 by saying they would take over paying the bank loan on the car.

The trio was represented by defence counsel Rozaiman Abdul Rahman during the trial. The prosecution called a total of five witnesses. However, Presiding Senior Magistrate Hj Nabil Daraina PDH Badaruddin ruled that there was no prima facie case against the defendants.

During the voir dire, or mini-hearing held during the trial, the prosecution tried to submit five statements from the three defendants, but the court ruled that the statements weren’t made voluntarily and that the prosecution didn’t have enough evidence to show there was a case to answer.
