Sales assistant found guilty of groping customer

A SALES assistant at a fabric shop in Serusop was found guilty yesterday for the charge of groping a customer last year.

During the proceedings yesterday, the defendant, an Indian national, Silambarasan Gunasekaran, was sentenced to serve eight months in jail and one stroke of the cane for the offence.

Silambarasan claimed trial last year over the charge of outraging modesty when he used “criminal force” on Miss X, a 31-year-old woman, by groping her right breast on January 17, 2015.

The defendant claimed that the incident was an accident as the complainant had made a sudden movement when he was putting the shirt on her back which cause the shirt to fall and touched her shoulder.

In delivering his judgment yesterday, the Chief Magistrate Muhammed Faisal PDJLD DSP Hj Kefli said that Miss X was a credible witness as she was able to recall the incident with accuracy and her reaction throughout the trial further showed that she was being truthful.

The complainant’s evidence was further supported by the shop’s CCTV camera which had recorded the incident and showed that the defendant had let go of the shirt and groped the complainant’s breast.

The CCTV also showed that the defendant was laughing at the complainant after the incident and made no attempts to apologise to the victim throughout the whole ordeal.

In his mitigation yesterday, the defendant has since apologised, and in his statement expressed remorse over the incident.

Silambarasan further said that he is supporting his ageing mother in India and that he did not cause any serious harm to the complainant. Following the verdict yesterday, the court ordered the defendant to serve the sentence with immediate effect.
