A 36-YEAR-OLD man was yesterday charged with raping his 13-year-old daughter.

During the proceedings at the Magistrates’ Court, Prosecuting Officer Siti Nurjauinah Hj Kula said they recently received new evidence, namely the result of the medical report, which led to the filing of two rape charges against the defendant.

The court document stated that the first incident allegedly occurred between March 2013 and March 2014 while the other incident took place sometime in February this year.

The defendant, whose name is being withheld to protect the identity of the victim, was initially charged with outraging his daughter’s modesty, which carries up to five years in prison and an unspecified number of lashes.

However, with the current rape charges, he could face up to 30 years in prison and a minimum 12 strokes of the cane.

Magistrate Dewi Norlelawati Hj Abd Hamid yesterday granted the prosecution’s application for the case to be remitted to the High Court.

The defendant, who is unrepresented, has been ordered to be further remanded at Jerudong Prison pending mention of his case in the next two weeks.

A further mention of the case is scheduled to be heard on October 5 at the Magistrates’ Court if no dates have been set to appear before the High Court.
