Man faces seven years for sex with minor

A MALAYSIAN man is facing up to seven years in prison after the Magistrates’ Court convicted him of engaging in sex with a minor.

Court documents state that the defendant, Ahmad Karim, engaged in sexual intercourse with the 14-year-old girl (known as Miss X) after he and Miss X’s boyfriend picked her up from religious school on October 6, 2011.

The two men then brought Miss X to Ahmad’s house in Bengkurong, where she had sex with her boyfriend first.

The victim claimed that after her boyfriend left the room, the defendant forced himself on her, but that she could not fight him off or call for help as she was in a weak state.

Her boyfriend later confronted her about the incident and she told him she was afraid Ahmad would hit her.

When she returned to school later that day, she fainted and was brought to hospital by her father.

On the way to RIPAS Hospital, she told her father she had sex with two men that day.

During the court judgment yesterday, Magistrate Ak Shahyzul Khairuddien Pg Abd Rahman said that he believed Miss X’s testimony that the sexual intercourse was forced, finding her evidence “unshaken”.

He added that the defendant did not have a defence, as he did not take any steps to ascertain Miss X’s age.

Section 2 of the Unlawful Carnal Knowledge Act states that “any person who has or attempts to have carnal knowledge of a girl under the age of 16, except by way of marriage, shall be guilty of an offence”.

The penalty mandated by law is between two to seven years’ imprisonment, plus whipping.

The court will sentence the defendant on Thursday.
