Man accused of possessing 50 cartons of untaxed cigarettes discharged

A 52-YEAR-OLD man accused of possession of over 50 cartons of untaxed cigarettes was discharged yesterday after the prosecution withdrew the charges against him.

During yesterday’s proceedings, prosecuting officer Danial DSP Kifrawi told the court that they would not pursue the charges further against the defendant, Muhammad Azlan Abdullah.

Muhammad Azlan had claimed trial to the charge of possession of 59 cartons of untaxed cigarettes of various brands and three packets of chicken wings weighing at two kilogrammes each.

The court document submitted by the prosecution states that the defendant was in possession of the untaxed goods while inside a vehicle at the vicinity of Customs Kuala Lurah Control Post last April 5.

Possession of untaxed cigarettes carries a fine of up to 20 times the excise duty or $40,000, whichever the greater amount, while possession of prohibited goods carries a fine of five times the amount of the goods or $40,000, whichever is the greater amount.

Following the prosecution’s application, the presiding magistrate Azrimah Abd Rahman granted the discharge not amounting to an acquittal.
