Defendant claims trial in molestation case

A MAN is claiming trial at the Magistrates’ Court to the charge of outraging the modesty of a 10-year-old boy.

The court document states that on October 21, at a school in Kg Rimba, the defendant Hammirol Awang Hamidon, is accused of using criminal force on Mr X, by touching the boy’s genitals and then forcing the boy to touch the defendant’s genitals and masturbate him.

During the proceedings before Senior Magistrate Pg Masni Pg Hj Bahar, the defendant told the court that he was not in the right state of mind at the time.

In view that the defendant has a defence, the senior magistrate scheduled a further mention of the case on December 17, before an assigned magistrate to fix trial dates.

The court further advised Hammirol to seek a lawyer for the trial as he is currently unrepresented.

The penalty under Section 354 of the Penal Code carries a five-year jail term with whipping. The defendant has been released on bail pending the next mention of the case.
