Court acquits police constable accused of not paying maid

A POLICE constable who was accused of not paying his maid for a year was acquitted by the Magistrates’ Court yesterday.

Defendant PC Hj Noraidil Hj Abu Bakar was charged with 13 counts under Section 39 of the Employment Order 2009 for failing to pay Yoyoh from September 2011 to September 11, 2012. The alleged unpaid wages amounted to $2,434.

Each of the offences carries a maximum fine of $3,000 and one year’s imprisonment.

During the proceedings yesterday, Senior Magistrate Hj Nabil Daraina PDH Badaruddin said the complainant had negated the fourth ingredient of the charge when she testified that her salary had been paid but was not received.

“I cannot say that a prima facie (case) has been made from the defendant to justify a defence call,” said the senior magistrate.

The court further ordered the policeman’s surety be discharged.
