Syariah: Full enforcement 24 months after gazetting
THE Syariah Penal Code will be fully implemented 24 months after the Syariah Penal Code 2013 is gazetted, said Dato Seri Setia Hj Tasim Hj Akim, Director of Islamic Legal Unit.
Dato Hj Tasim addressed some 200 participants of the Knowledge Convention at the Temburong Community Hall in conjunction with His Majesty's 67th birthday celebration yesterday.
The participants — grassroots and community leaders as well as teachers and invited guests — were briefed on Syariah Law and its components by two speakers: Dato Seri Setia Hj Tasim who spoke about the Syariah Penal Code, and Siti Zaliha Hj Abu Salim, a senior lecturer at Universiti Islam Sultan Sharif Ali.
Siti Zaliha presented a talk on “Hukum Takzir di dalam kesalahan hudud dan qisas”.
Syariah Law was the focus of this year's knowledge convention across the country, which aimed at highlighting and creating awareness on the recently reintroduced Syariah Law.
The knowledge convention had been held in three districts as to date. The last knowledge convention will take place in Belait on November 19.
His Majesty in his titah during the convention's launch on October 21 at the capital said Islamic laws will be enforced in phases. Brunei will enforce the Syariah Penal Code in April 2014.
Dato Hj Tasim, during the knowledge convention in Temburong, elaborated the phases to the audience.
The law will be implemented in phases to make room for necessary infrastructure/resources to be put in place, that is needed for its smooth implementation.
Dato Hj Tasim said six months after the Syariah Penal Code 2013 is gazetted (April 2014), provisions that will be enforced (under the Syariah Law) are those under general offenses in Part IV, Chapter IV, except offenses punishable by death or flogging under this chapter.
Some of the offenses under Part IV, Chapter IV include, failure to perform Friday prayer, disrespecting month of Ramadhan, khalwat (close proximity/unmarried couple in compromising situation), indecent behaviour, man posing as woman or vice versa, instigating married man or married women to divorce or neglect duties, preventing Muslim married couple from cohabiting and enticing or causing Muslim married woman to leave matrimonial home.
The second phase, he said, which will take place 12 months after the Syariah Penal Code 2013 is gazetted will be the enforcement of offenses under Section IV, chapter I,II and III that are liable for hadd (punishment or penalty as ordained by al-Quran and sunnah Rasulullullah SAW), qisas (retribution), diyat (compensation) except for offenses that carry the death penalty.
The third and final phase, Dato Hj Tasim said will take place 24 months from the day the penal code is gazetted.
Under this phase, the Syariah Penal Code 2013 will be enforced in full including the implementation of the death penalty.
The Deputy Minister of Religious Affairs, Pg Dato Paduka Hj Bahrom Pg Hj Bahar attended the knowledge convention.
Also present at the knowledge convention were Temburong Legislative Council member, Yang Berhormat Hj Sulaiman Ahad, Temburong Acting District Officer, Hj Abdul Hamid Dato Paduka Hj Abdullah as well as senior officials from the Prime Minister's Office and Ministry of Religious Affairs.
